Terms of Use

1. This agreement

These terms are between you and Binder Gallery, an independent developer based in Mexico City. By installing or using the app you accept them. If you don’t accept them, don’t use the app.

2. Your licence to use the app

We give you a personal, non-exclusive, non-transferable licence to install and use Binder Gallery on devices you own or control, for your own use. We keep ownership of the app, its code, its design and its name.

Your collection data is yours. We don’t claim ownership of the cards you record, the binders you build or the photos you use as covers.

3. Binder Gallery Pro

The app is free. Binder Gallery Pro is an optional one-time purchase — not a subscription — that unlocks cosmetic features: additional finishes, a photo cover, a holo effect, watermark-free exports and alternative app icons. It does not add cards, prices or storage.

The purchase is tied to the Apple or Google account that made it, and can be restored on another device signed in to that same account.

Refunds are handled by the store, not by us. Apple and Google process the payment and apply their own refund policies and statutory consumer rights; we have no ability to issue or deny a refund. Ask the store first. If something went wrong, write to us anyway and we’ll help you make the case.

We may change what Pro includes. If we remove something you already paid for, we’ll say so in advance in the app.

4. Price estimates are estimates

This is the most important clause on this page. Prices shown in Binder Gallery are estimates compiled from third-party sources — among them TCGdex, tcgcsv.com, Cardmarket and currency rates from Frankfurter. They are:

• not appraisals, valuations or professional advice;
• not offers to buy or sell anything;
• not guaranteed to be accurate, current or complete;
• often absent entirely for unusual cards, variants or languages.

Card markets move quickly and condition, language, edition and grading change a card’s worth enormously. Do your own research before buying, selling, insuring, trading or grading anything. We are not responsible for a decision you make based on a number the app showed you.

5. Acceptable use

You agree not to:

• reverse engineer, decompile or tamper with the app, except where law allows it;
• scrape, bulk-extract or resell data obtained through the app;
• use the app to break the law, infringe someone’s rights, or upload content you have no right to use;
• interfere with the app’s servers or with other people’s use of it;
• circumvent payment for Pro, or distribute copies of the app.

We can suspend or delete an account that is being used this way.

6. Trademarks that aren’t ours

Binder Gallery is an independent app. It is not affiliated with, endorsed by or sponsored by The Pokémon Company, Nintendo, Creatures Inc. or GAME FREAK. Pokémon, card names and card images are the trademarks and copyrights of their respective owners, and nothing in the app or on this site claims any right over them.

7. Availability

We’d like the app and its cloud backup to work all the time, but we can’t promise that. Services can go down, third-party price sources can stop responding, and we may change or discontinue features. The app’s core — your collection on your phone — is designed to keep working without any of our servers.

Keep your own backups of anything you can’t afford to lose.

8. Disclaimer and limitation of liability

The app is provided “as is”, without warranties of any kind beyond those the law requires and does not allow us to exclude.

To the fullest extent the law permits, we are not liable for indirect or consequential losses, lost profits, or the loss of collection data. Where we are found liable despite this, our total liability is limited to the amount you actually paid us for Binder Gallery Pro, or zero if you never bought it.

Nothing here limits the consumer rights you have under Mexican law, which apply regardless of what this page says.

9. Changes to these terms

We may update these terms. The effective date at the top changes when we do, and significant changes will be announced in the app. Continuing to use the app after a change means you accept the new version.

10. Governing law

These terms are governed by the laws of Mexico. Any dispute will be heard by the competent courts of Mexico City, without prejudice to any right you have as a consumer to bring a claim where you live.
